1. Agreement and eligibility
These Terms of Service (“Terms”) are a proposed agreement between you and Fraction Compliance Inc., a Washington C Corporation (“Fraction Compliance,” “we,” “us,” or “our”), for your use of MaPause and related websites, apps, and services (the “Services”). By using the Services after these Terms become effective, you agree to them. If you do not agree, do not use the Services.
You must be at least 18 years old to use the Services. MaPause is intended for adults and is not directed to children or minors. We use a simple age self-attestation and do not collect government identification for routine age checks. We do not offer a parental-consent path; users who cannot make the attestation must not use the Services.
2. What MaPause is — and is not
MaPause is a relationship-support and self-reflection tool intended to help people make space, breathe, and return to a conversation with more care. It is not medical, mental-health, crisis, legal, or professional relationship advice, and it does not diagnose, assess, score, or guarantee the health or outcome of a relationship.
If you or another person is in immediate danger, contact local emergency services or a qualified crisis resource. Do not rely on MaPause for emergency support.
3. Accounts and authentication
Some features require an account. MaPause supports Google sign-in, email-and-password accounts, and passwordless magic-link sign-in through its authentication service. Provide accurate information, protect credentials, and promptly tell us about unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of applicable law.
Google and other authentication providers may have their own terms and privacy practices. You are responsible for keeping access to your sign-in email and recovery methods secure.
4. Couple invitations and shared use
If a pairing or invitation feature is enabled, use it only with the consent of the other person. An invitation may show limited sender or account information needed to identify the request, but no photos, messages, pause content, or other relationship content is shared until both users explicitly accept. Invitations remain valid for 24 hours, and pending invitation records are purged after 30 days. Either person may unpair at any time, which stops future shared sync; copies already stored locally on either device must be deleted through that device’s controls. Do not use another person’s email, invite, account, photos, or private information without authorization.
5. Your content
You retain your rights in content you submit or make available through the Services, such as photos, prompts, or profile information (“User Content”). You grant Fraction Compliance a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use User Content only as reasonably needed to provide, secure, maintain, and support the enabled Services, including sharing it with people or providers you direct through an enabled feature. We may authorize service providers to exercise those rights solely on our behalf for those purposes.
This license ends when you delete the applicable User Content or your account, except for copies that remain in backups, security records, or legally required records for only as long as reasonably necessary before deletion or overwrite. Fraction Compliance does not sell User Content or use it for targeted advertising.
After a verified deletion request, we will remove active account, pairing, and cloud User Content copies from systems we control within the applicable request process. Provider-managed backups and disaster-recovery copies age out under the provider’s actual schedule; this draft does not promise a universal backup-deletion deadline. Legally required records and narrowly scoped security records may be retained only as reasonably necessary, with access limited to that purpose.
You represent that you have the rights and permissions needed to submit User Content and that doing so does not violate law, another person’s rights, or an agreement. Do not submit content you do not want processed under the final product behavior.
6. Local photos and device data
Selected photos are stored in the app’s local collection and are not uploaded automatically. Your device, operating system, backup provider, or a user-initiated third-party integration may copy or process app data under its own controls. We do not promise that deleting the app or a local item removes every backup copy.
7. Third-party services
The Services may interoperate with Apple, Google, YouTube, Spotify, app stores, or other providers. Provider availability, permissions, content, and data practices are controlled by those providers. You are responsible for complying with their applicable terms. Amazon integration is not included in the current product scope.
8. Acceptable use
You may not:
- break the law, violate another person’s rights, or use the Services to harm, threaten, stalk, or harass someone;
- interfere with the Services, bypass security, probe systems, or introduce malicious code;
- scrape, copy, reverse engineer, or commercially exploit the Services except as permitted by law;
- misrepresent your identity, obtain access to another person’s account, or use an invite without consent; or
- use MaPause to make an automated diagnosis, relationship score, safety decision, or high-stakes decision.
9. Intellectual property
The Services, including MaPause branding, software, illustrations, text, audio, design, and other materials supplied by Fraction Compliance, are owned by or licensed to Fraction Compliance and are protected by applicable law. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for personal, lawful purposes. No other rights are granted.
10. Feedback
If you provide suggestions or feedback, you allow us to use it without restriction or compensation, subject to the final privacy notice and applicable law. Do not send confidential information through an unconfigured support channel.
11. Availability and changes
We may modify, suspend, or discontinue features, including optional provider integrations, at any time as the product develops. We do not promise uninterrupted availability, compatibility with every device, or that a planned feature will launch. Maintenance, beta, regional, store, and provider limitations may apply.
12. Fees and purchases
The current MaPause build does not require payment, and cloud coordination is available without a subscription while the premium feature flag is off. If we enable a paid subscription or in-app purchase, the purchase screen and applicable store terms will disclose the price, billing cycle, renewal, cancellation, refund, and taxes before purchase.
13. Privacy
Our Draft Privacy explains how information may be handled. The two documents are intended to match the shipped build, backend, SDKs, app-store disclosures, and provider configuration.
14. Suspension and termination
We may suspend or terminate access immediately where reasonably necessary for safety, security, fraud, abuse prevention, legal compliance, provider requirements, or an urgent material risk. For an ordinary material violation or repeated misuse where there is no urgent risk, we will give notice and a reasonable opportunity to cure when practical. If you believe an action was mistaken, you may ask the confirmed support channel to review it; this review path has no guaranteed response time or promise of reinstatement, and urgent safety or security measures may remain in place while it is reviewed. You may stop using the Services at any time.
Account deletion instructions and the current implementation boundary are described on the account deletion page. This highlighted language is a working draft choice, not final legal approval.
15. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, or that the Services will improve a relationship or meet a particular need. Some jurisdictions do not allow certain disclaimers, so this section must be reviewed for the users and markets served.
16. Limitation of liability
To the maximum extent permitted by law, Fraction Compliance and its officers, directors, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, data, goodwill, or opportunities, arising from or related to the Services or these Terms.
Except for liability that cannot lawfully be limited, or liability arising from gross negligence, willful misconduct, intentional harm, or fraud, Fraction Compliance’s aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of the amounts you paid or owe for the Services during the 12 months before the event giving rise to the claim or $100. Nothing in this section limits a right or remedy that cannot lawfully be limited.
The final cap, exclusions, and required consumer-law carve-outs remain subject to human/legal review.
17. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Fraction Compliance Inc. and its officers, directors, employees, agents, contractors, licensors, service providers, successors, assigns, and representatives from and against any claims, demands, investigations, actions, judgments, settlements, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising out of or relating to your access to or use of the Services, your User Content, your breach of these Terms, your violation of law or another person’s rights, your fraud, abuse, or willful misconduct, or a dispute or harm between you and another person arising from your use of MaPause. This obligation applies to third-party claims and, to the extent permitted by law, direct claims between you and Fraction Compliance. It does not require indemnification to the extent liability cannot lawfully be shifted or the claim results from Fraction Compliance’s gross negligence, willful misconduct, intentional harm, or fraud. Fraction Compliance may control the defense and settlement, and you will reasonably cooperate; no settlement may admit Fraction Compliance’s liability or impose an obligation on it without its written consent.
Counsel must review scope, first-party coverage, carve-outs, and enforceability before publication.
18. Governing law and disputes
These Terms are governed by the laws of Washington, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Services or these Terms may be brought in a court of competent jurisdiction. No mandatory arbitration, class-action waiver, or jury-trial waiver is included in this working version unless counsel separately approves it and applicable law permits it.
The court venue wording is a separate choice below. This section must be completed by counsel for the intended markets.
Any court-based dispute may be brought in a court of competent jurisdiction.
A named county is optional and remains subject to counsel’s market-specific review.
19. General terms
If a provision is unenforceable, the remaining provisions remain in effect to the extent allowed by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or sale of assets. These Terms and documents incorporated by reference are the entire agreement about the Services, subject to any mandatory consumer rights.
